820 & 801 - Partner Visa (Apply within australia)
This visa will allow you as the spouse or de facto partner of an Australian permanent resident, Australian citizen or eligible citizen of New Zealand to permanently live within Australia. Both the temporary partner visa and the permanent partner visa will need to be applied for together as part of the process. Please note there are limitations on how many partners an Australian may sponsor. In certain situations, it may be possible to seek a waiver to the limitation based on compelling circumstances.
Subclass 820 (Temporary) and Subclass (801 Permanent) partner visas are lodged simultaneously.
Temporary Partner visA (subclass 820)
This visa will allow you to reside within Australia temporarily while your permanent Partner visa (subclass 801) is processed.
To be eligible:
● your de facto partner or spouse must be an Australian citizen, Australian permanent resident or eligible citizen of New Zealand and will usually be your sponsor
● you must meet relevant relationship requirements to prove you are in a genuine relationship
● you must be over 18 years old
● you must meet health and character requirements
● you must have no outstanding debt obligations to the Australian government
● you must be physically present in Australia for lodgement of this application
*If you are or have previously been the holder of a Prospective Marriage visa you may include a family member at the time of application.
This visa will allow you to:
● Work, study and live within Australia while a decision is being made
● Travel as desired (unless you are a holder of a Bridging Visa with no travel rights)
● Attend free English language classes
● Access Medicare
● Include dependent children in your application
Permanent partner visa (subclass 801)
This visa is for the holder of a temporary Partner (subclass 820) visa and will allow you to permanently reside within Australia.
To be eligible:
● Your relationship with your de facto partner or spouse must still exist (exemptions apply)
● Your sponsorship should be continuing
● You must be the holder of either a temporary Partner visa (subclass 820) or Dependent Child visa (subclass 445)
● You have no debt obligations to the Australian government
This visa will allow you to:
● Work, study and live within Australia indefinitely
● Travel as desired for 5 years from the date this visa is granted
● Attend free English language classes
● Access Medicare
● Bring eligible family members to Australia through sponsorship
● Apply for Australian citizenship, if eligible
