Labour market testing (LMT) involves advertising the nominated position in Australia. The purpose of the LMT is to demonstrate to the Department of Home Affairs that you are unable to find a suitable Australian citizen or permanent resident employee to fulfill the nominated position.
The position must have been advertised for at least four weeks within the four-month period immediately prior to lodging the nomination application.
On 11 December 2023, the Migration Instrument was updated to remove the requirement for employers to advertise on Workforce Australia website for subclass 482 – Temporary Skill Shortage visa and subclass 494 – Skilled Employer Sponsored Regional (Provisional) visa nomination applications. This means employers must now conduct two valid advertisements, instead of three.
This change will allow employers greater flexibility in relation to how employers undertake the LMT process.
