Minister’s Personal Procedural Decisions on Existing MI Requests

On 4 September 2025, the Hon Tony Burke MP, Minister for Home Affairs, Minister for Immigration and Citizenship, and Minister for Cyber Security, made Personal Procedural Decisions (PPDs) concerning requests for Ministerial Intervention (MI) under sections 351 and 501J of the Migration Act 1958.

Under these PPDs, the Minister determined that:

  • MI requests lodged on or before 11 April 2023 will not be considered, unless the request is already the subject of a Minister’s personal procedural decision, a substantive public interest decision, or the individual is listed in the annexure to the PPD.
  • MI requests lodged on or after 12 April 2023 may be considered, provided the request meets at least one of the criteria outlined in the PPD.

Individuals who submitted an MI request on or before 11 April 2023, and whose case has not been the subject of a Minister’s decision or is not listed in the annexure, will be notified (either individually or through public notification on the Department’s website) that their request has been finalised. These individuals may submit a new MI request to bring their circumstances to the Minister’s attention, which will be assessed by the Department in line with the Ministerial Instructions.

For MI requests lodged on or after 12 April 2023, if the request has not yet been the subject of a Minister’s decision, it will be referred to the Minister for consideration only where the Department assesses that the case meets at least one of the criteria set out in the PPD. Applicants will be notified of the outcome once the Minister has made a decision. Any new MI requests will also be assessed by the Department against the latest Ministerial Instructions to determine eligibility for referral.
