One of the requirements for visas 482 and 494 is that the position offered by business sponsors is published for at least 28 days on three job platforms. Therefore, the advertisement must meet specific requirements for it to be considered valid for LMT (Labor Market Testing) purposes for Immigration purposes.
However, what employers must be aware of is that the advertisement must also meet other requirements to avoid future problems with the FWA (Fair Work Australia). These requirements encompass the anti-discriminatory and ethical criteria enforced by the various Acts of Australian Legislation.
Some of these criteria are, for example:
• Respect for ethnic, racial, religious, social differences, etc;
• Content of the advertisement must be limited to the vacancy only, not stating the preference for certain candidates over another;
• Advertisement must not contain preference for individuals of a certain nationality;
• Content must not refer to third parties as a means of comparison;
• Job Advertisement content must be reliable and truly offers the salary and the advantages that it states on the content.
Although the list mentioned above is exemplary in nature, it is recommended that an HR professional review the content of the job advertisement to check whether it meets the ethical standards listed by the FWA.
